The Jordan City Council voted 5-2 Monday night to sue the mayor for not signing an ordinance related to crematories.
After a recommendation from City Attorney Annette Margarit, the council approved going to Scott County District Court for an alternate writ of mandamus.
A mandamus would order Mayor Pete Ewals to appear in court and explain his basis for not signing the ordinance, which would allow crematories as accessory uses to funeral homes. If the court is not satisfied with Ewals’ explanation, the court can order the mayor to sign the ordinance.
Margarit said the court date would take place within a month, but the city would incur legal fees in the process. Ewals and Councilmember Thom Boncher voted against going to court.
