The Minnesota Court of Appeals has the job of settling the crematory debate in Jordan, and the issue may come down to a battle over words.
On Wednesday, the Jordan Community Action Group and attorneys for the city of Jordan argued over the legality of Ballard-Sunder Funeral Home’s conditional-use permit for a crematory.
Last year, a Scott County District Court ruling rendered the funeral home’s CUP null and void, but the city appealed the decision. Wednesday’s hearing was heard by a three-judge panel at the Minnesota Judicial Center in St. Paul.
A League of Minnesota Cities attorney defended the CUP, saying a funeral home and crematory can be one in the same. An attorney for JCAG disagrees, claiming that state law treats funeral homes and crematories differently.
