Judge dismisses lawsuit against DNR in Carver County 07 May 12

A Carver County judge has dismissed a lawsuit that would hold the DNR more accountable for preventing spread of zebra mussels between west metro lakes.

A group of property owners and lake associations with Lotus Lake, Lake Bavaria, Christmas Lake and Lake Minnewashta sued the DNR in March, arguing for boat inspections at a central location to help prevent zebra mussels from getting into their lakes.

Last month, District Court Judge Philip T. Kanning dismissed the group’s request for a temporary injunction, instead agreeing with the DNR that it did not have statutory authority to set up the inspection stations away from lakes.

DNR officials say the agency is about to launch its largest-ever public information, enforcement and watercraft inspection campaign to curb against the spread of aquatic invasive species.
